Terms of Use

1. Agreement to these terms
These Terms of Use ("Terms") govern your access to and use of MISPLACED Sports Analytics, including misplacedanalytics.com and the free MLB beta (collectively, "MISPLACED"). MISPLACED is operated by Herford Analytics LLC. By using MISPLACED, you agree to these Terms. If you do not agree, do not use the service.
2. Informational analytics service
MISPLACED provides sports analytics, model probabilities, matchup information, market comparisons, model-performance information, Diamond Rating™, Rough Value™, Series Opportunities, and related tools. MISPLACED is an informational analytics product. It does not place wagers, accept bets, act as a sportsbook, hold gambling funds, or guarantee any sports outcome.
3. Free MLB beta
The 2026 MLB version is being offered free for the remainder of the season as a beta test. Beta access may contain errors, incomplete data, delays, experimental features, or interruptions. We may add, remove, change, suspend, or discontinue beta features at any time.
4. Eligibility and lawful use
You are responsible for complying with the laws and rules that apply to you. If you use sports analytics in connection with wagering, you are responsible for meeting the legal wagering age and other requirements in your jurisdiction and for using only lawful, authorized services.
5. No guaranteed results
Probabilities are estimates, not promises. Historical performance does not guarantee future results. Player availability, lineups, injuries, weather, pricing, data feeds, and other conditions can change after MISPLACED generates or displays information. You are responsible for your own decisions.
6. Acceptable use
You may not:
- interfere with, damage, overload, or attempt to bypass the security of MISPLACED;
- use automated tools to scrape, harvest, copy, or extract the service at scale without permission;
- reverse engineer or attempt to obtain non-public source code, model logic, credentials, or protected systems;
- misrepresent MISPLACED data as guaranteed, official, or endorsed by a sports league or sportsbook;
- resell, republish, or commercially redistribute substantial portions of MISPLACED without written permission; or
- use the service for unlawful, fraudulent, abusive, or malicious activity.
7. Intellectual property
MISPLACED, the MSA branding, Diamond Rating™, Rough Value™, site design, software, analytics presentation, written content, and other original materials are owned by or licensed to Herford Analytics LLC except where otherwise stated. These Terms do not transfer ownership rights to you.
8. Feedback
If you voluntarily submit ideas, bug reports, suggestions, or other product feedback, you give Herford Analytics permission to use that feedback to operate, develop, improve, and commercialize MISPLACED without owing compensation for the suggestion itself. Personal information included with feedback remains subject to our Privacy Policy.
9. Third-party data and services
MISPLACED may rely on or display information derived from third-party sources and infrastructure. Third-party data can be delayed, incomplete, inaccurate, changed, or unavailable. References to leagues, teams, players, sportsbooks, or other third parties do not by themselves imply sponsorship or endorsement.
10. Availability and changes
We do not promise uninterrupted availability. We may perform maintenance, change infrastructure, adjust model logic, modify features, or temporarily disable portions of the service.
11. Disclaimer of warranties
To the maximum extent permitted by law, MISPLACED is provided on an "as is" and "as available" basis. Herford Analytics disclaims warranties that the service will be error-free, uninterrupted, complete, accurate, or suitable for any particular decision or result.
12. Limitation of liability
To the maximum extent permitted by law, Herford Analytics LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunities, gambling losses, or losses arising from reliance on sports analytics or third-party data. Nothing in these Terms excludes liability that cannot legally be excluded.
13. Termination or restriction
We may restrict or terminate access when reasonably necessary to protect the service, enforce these Terms, investigate abuse, comply with law, or protect users or Herford Analytics.
14. Governing law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except where applicable law requires otherwise.
15. Changes to these Terms
We may update these Terms as MISPLACED develops. Continued use after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
